Judge in Idaho declined a proposal from Bryan Kohberger’s defense team who asked to remove capital punishment as a potential punishment if he was found guilty.
Kohberger was charged with first -degree murder in the death of four students on University of Idahincluding Kaylee Goncalves, 21; Xana Kernodle, 20; Madison Mogen, 21; and Ethan Chapin, 20. A former student at the University of Washington has also been charged with a criminal number of burglary.
During the hearing on April 9, the Kohberger’s defense team made a proposal for the death penalty, claiming that the Discovery produced by the prosecutors and were voluminous and disorganized. Kohberger claimed that this means that he cannot meaningfully inspect and explore evidence in preparation for the trial, which should currently be started in August.
Judge Steven Hippler wrote on Tuesday in his order that Kohberger’s complaints were made on the amount of discoveries produced by “Ring Hollow”.

Hippler also wrote that Kohberger’s lawyer, Anne Taylor, “indicated that her practice was personally reviewing all the discovery itself, instead of relies on associates and staff to review materials to reduce less relevant information and indicate what materials they should review the leading advisor.”

“These actions do not indicate an overloaded defense team,” Hippler wrote about the proposal.
Addressing one of the arguments of Kohberger’s defense team that prosecutors “transferred their production to completely unimportant documents,” Hippler said that “no evidence” that this happened.

Hippler’s decision comes less than a week after declining a different proposal to remove the death penalty. Kherberger’s defense team He had previously claimed that the diagnosis of an autism of the defendant should prevent him from the death penalty.
