The universal prohibition gives individual judges outstanding power. Don’t like the law that has passed Congress? Left. Don’t like the regulation of the agency? Dead. You don’t like one of the president’s policies? Sayonara.

The only solution to the crisis of the judge of radical districts

Initially, these universal prohibitions were unusual. The courts only issued 27 universal prohibitions up to the 21st century. But in recent decades they have become a fact of life. President Joe Biden faced 14 universal prohibitions in his four -year term and president Donald Trump surpassed that number in less than four months.

Nowhere does the Constitution say that district courts have this immense power. Congress never authorized the courts to issue universal prohibitions. Universal prohibitions are also not recognized in England, where America received much of its jurisprudence.

However, individual judges across the country still claim that they have the authority to stop the entire federal government with a pencil impact.

Rogue, leftists caused by obsession with feelings, not facts

To make matters worse, judges often issue these universal prohibitions after preliminary hearing with a limited discussion of the parties. No jury. No trial. There is no real testing of evidence at all. This also means that the courts have little time to consider supreme legal issues. Because of this, judges are able to close federal policies across the country within a few days or even hours.

Since the prohibition may prohibit the implementation of the law or policy anywhere, the federal government is understandably felt forced to immediately complain about the case until the Supreme Court if necessary. This hurrying process is undermined by judicial decision -making.

This ensures that many legal scholars and judges have the opportunity to share their views and to check the problem completely. One rogue judge should not be able to force the Supreme Court to rush with complex legal issues because he took over the power to enjoy the federal policy across the country.

This is not an ideological question. Justices Neil Gorsuch, Clarence Thomas and Elena Kagan, expressed concern about the universal prohibitions of a brief compound of the American judicial system. This is not a partisan question either. Generals lawyers for President Biden and Trump have asked the Supreme Court to stop universal prohibitions.

These individuals understand better than anyone to angry the use of universal bans of the District Court judges that they will destabilize the judiciary, and indeed, our entire system of government. I hope the court will take the opportunity to end this illegal practice once and for all.
