On April 30, the Toms River City Settlement Council appointed a decree on its agenda to condemn a 10 -acre church, which includes the parish house, the auditorium, the school, the shrine and the deceleuous residence, under its eminent domain.

The city plan is to convert the assets of the Congregation into the recreational area.
“Every government agency has the right to condemn the property for state purposes. This is clear. However, the city never considered it a recreational place,” York said. “To say they need a recreational land flying in front of the facts and their main plan.”
York and his legal team claim that the move to take away the property is a direct response of the city to the church initiative of the shelter.
“It is clear that this is done in retaliation for the Church submitted to the homeless shelter,” he said, pointing to the constitutional protection of freedom of religion and the federal religious use and institutionalized persons.
“I do not know that you will find a lawyer who will say, ‘Oh, yes, they have the right to do so; they will win.”
