AND The state of California Agreed in the Federal Court on Monday to stop prohibiting children with disabilities who want to attend religious private schools to receive special education funding.
For decades, children with disabilities have been able to approach federal financing for free Special education and related services under the Law on Education of Persons with Disabilities (Idea). Federal law allows some of these funds to be used in private schools, but California legislators have disqualified religious private schools from access to this program by this week.
A group of Orthodox Jewish parents and schools first launched a lawsuit against the California Ministry of Education in 2023 because of this state law, which forbidden them to receive funds for ideas to send their children to the Orthodox Jewish schools.
Parents claimed that their children should be able to obtain education that is in line with their Jewish traditions and beliefs, while providing quality education that meets their needs.

“It is uncertain that California politicians use religion as an excuse to deny special educational benefits to children with disabilities,” Nicholas Reaves, an older becket advisor, a legal group representing her parents, said previously Fox News Digital. “Exclusion of religious schools from a program that helps these children to achieve their full potential is simply wrong.”
In October, the federal appeal of the court agreed, declaring that the California was breaking the Constitution, demanding that schools would be non -religious to apply for families for these funds.
The case returned to the district court. On Monday, California and Unified School District in Los Angeles agreed to a court order This permanently forbids them to conduct a “non -internal” request for access to financing special education.
Becket greeted the court’s victory in a statement for the public.
“California spent decades by treating Jewish children like the second grade citizens. Today’s settlement ensures that Jewish children with disabilities can access the resources they need and deserve-like everyone else,” said Eric Rasbach, Vice President and older advisor in Becket.
