“The request to continue due to the significant amount of the investigation and the preparation of the trial of the still extraordinary, as well as the recent and upcoming publicity, which is very harmful to defense,” the application said. “Any condemnation and sentence created from the Capital trial, beginning with August 2025, will be unconstitutionally imposed and, therefore, subject to a reversal on a direct or collateral examination.”
The new information on the killings was presented during the NBC “Dateline” program on May 9, which included surveillance recordings from a nearby house. The surveillance video was shown by a car similar to the Kohberger, which was in the King Road House area several times just before four students were killed.

The episode also suggested that some of the reports had been weak. According to the documents, the material was obtained from sources close to investigations.

Forensic expert and professor of Jacksonville State University Joseph Scott Morgan Said Fox News Digital, there is a risk that the TV episode on Kohberger will extinguish the jury pool.
“I think the first place to look for to renovate the pool, the jury pool,” Morgan said. “Progressive, it gets harder because people form opinions, they put things that are not true, and you still have no choice. And that is not like going to Manhattan. You talk about Ada district, Idaho. You have a limited set of potential jurors there.”
