UK Supreme Court rules legal definition of woman is biological


Supreme Court United Kingdom On Wednesday, she ruled that a woman was born biological female, a move that now excludes a transgender woman from a legal definition of a woman.

Trans women can be excluded from some single -pointed spaces and groups according to the Law on the Equality of the United Kingdom, the five judges of the highest court ruled. These spaces and groups include locker rooms, homeless shelters, swimming spaces and medical or Counseling secured only to women.

The verdict means that even a transgender person with a certificate who recognizes them as a female should not be considered a woman for the purpose of equality.

But justice Patrick Hodge said his verdict “does not remove protection against trans people,” who are “protected from discrimination based on gender diverting.”

“The interpretation of” sex “as certified sex would intersect the definitions of” man “and” women “… and, in this way, a protected sexuality of sex in a mismatched way,” Hodge said. “That would create heterogeneous groups.”

“Everyone knows what sex is and you can’t change it,” said Susan Smith, a co-designer for the Scottish women, who brought the case. “It is common sense, the basic common sense and the fact that we were in a rabbit hole in which people tried to deny science and deny reality and hope that it would see us now, back to reality.”

Hannah Ford, an employment lawyer, said that although the verdict would provide clarity about the controversial issue of the UK, it was a failure for transgender rights and there would be a “battle uphill” to ensure that jobs are welcome for trans people.
