US Appeal Court ordered Trump administration This week, in accordance with the command of the lower court judge to return the 20-year-old Venecuela Migrant deported from the United States to El Salvador in March, which marked another failure in legal battles over his use of the Enemy Law.
Decision 2–1 from the leaves of the 4th round at the point American District Judge Stephanie Gallagher’s The earlier verdict that Daniel Lozano-Camargo, previously identified in court documents as “Cristian”, must be allowed back to the country.
Gallagher, the appointed Trump, ruled that the removal of Lozano-Camarga had violated the agreement that the Ministry of Homeland Security had hit a group of other migrants who entered the US illegally as children and later sought asylum. DHS agreed that they would not deport these individuals who later sought asylum in the US until their cases could not be completely judged in court.
The decision inserts the path that Trump’s administration complains of the Supreme Court. In the meantime, Gallagher said she would amend his verdict to set a formal time tape for the government to return a 20-year migrant in the United States

AND Ministry of Justice He appealed to the case of the fourth round earlier this month.
The opinion of the majority, published on Monday night, rejected their request, emphasizing what the judges said that their role in ensuring that the courts had the opportunity to prevent any attempt to “degradate an effective judicial audit” executive.
“As it becomes too common, we are again faced with the efforts of the executive authority to abolish the rule of the law in search of our goals,” said Judge Deandrea Gist Benjamin, writing for the majority. “It is the duty of the courts to stand as a bulk against political tides that seek to overcome constitutional protection and fundamental principles of law, even in the name of noble goals such as public security.”
“The Government’s violation denied Cristiana in favor of the negotiation and the process that needed,” Gregory added.

Gallagher ruled in April that the Government had violated the settlement 2024. Between DHS -Ai A group of young asylum seekersincluding Lozano-Camargo. According to that agreement, DHS agreed that they would not deport migrants, who all entered the US as unaccompanied children, until their cases were completely heard in court.
Last month, Gallagher said that the deportation of Lozano-Camarga was “a violation of the contract” because his asylum case had not yet been heard and ordered the US government to arrange his release. Trump’s administration lawyers claimed that Lozano-Camargo was acceptable to remove the Law on Aliens Enemies, citing his arrest and conviction of accusations for possession of cocaine in January. They also claimed that, without evidence, he was a member of the “violent terrorist gang”.
Gallagher repeated her previous decision this month, emphasizing that it had nothing to do with the power of his asylum request in the climate on two apparent low -level drugs. Instead, she emphasized, it was a matter of a duty.
The government is “measuring the utility program using the wrong measure,” she said to the administration, adding that it was not the case if Lozano-Camarmgo would eventually obtain asylum, but his procedure was provided in the meantime.

The process, she said, is important for various reasons, noting that even when the outcomes in certain criminal cases or trials make obvious, individuals still have the right to trial under US law.
“We don’t skip to the end and say,” We all know how it will end, so we’ll just skip that part, “she said.
This was also supported by judges of the appellant.
“The Government’s violation denied Cristiana in favor of the negotiation and the process he needed,” Benjamin said, writing for the majority.

The job of the courts is “to say what the law is,” she said. “The task is sensitive, but it cannot be pierced.”
It is unclear whether Trump’s administration will regret the Supreme Court case.
